TERMS OF SERVICE

By commissioning me or purchasing one of my adoptable designs, you agree to the applicable terms below.

1. GENERAL

I reserve the right to decline any commission request for any reason.
I only accept commissions that fit my style, interests, and comfort zone.
Requests outside the scope listed on my price page may be declined or discussed individually.
Please provide all available references and important design details before work begins. If the commission includes character design or redesign, the required materials will be discussed individually.
Changes caused by important information being omitted or changed after work has begun may require an additional fee.

2. PAYMENT

Full payment is required upfront by default after the commission details have been confirmed.
Payment is currently accepted via PayPal unless otherwise agreed.
Prices are listed in USD.
For commissions totaling $300 or more, a custom payment plan may be discussed and agreed upon before work begins. Payment plans are offered on a case-by-case basis and are not guaranteed.
An initial payment is required before I begin work. The amount of the initial payment and the remaining payment schedule are agreed individually depending on the commission size and complexity.
Work may be paused until the next agreed payment is received. Final files will only be delivered after the full commission price has been paid.

3. QUEUE / TURNAROUND

Commissions are completed in queue order unless otherwise agreed.
Turnaround estimates begin once I start actively working on your commission, not when the slot is reserved.
Delays caused by slow communication, missing references, or major client-side changes may extend the deadline.
I will inform you if I expect a significant delay.
Any specific deadline must be discussed and accepted before payment.
Rush / priority work may be available for an additional fee depending on the deadline and complexity.

4. REVISIONS

Minor edits are allowed during the sketch / early approval stage.
Once a sketch or composition has been approved, major changes may require an additional fee.
Small final corrections may be possible, but they do not include major redraws, pose changes, or redesigns.
Repeated or excessive changes may be charged separately.

5. REFUNDS / CANCELLATION

If you cancel before I begin work, you will receive a full refund minus any non-refundable payment processing / transfer fees.
If work has already started, only the unfinished portion of the commission is refundable.
I reserve the right to retain payment proportional to the amount of work already completed.
If a sketch or another work stage has already been completed and shown, that completed portion is non-refundable.
No refunds will be given after the commission is finished and the final files have been delivered.
If I cancel the commission, I will refund the unfinished portion. If no substantial work has been completed, a full refund will be issued.

6. USAGE / COPYRIGHT

I retain the copyright to the artwork unless otherwise agreed in writing.
By default, commissions are for personal use only.
You may repost the finished artwork for personal use as long as proper credit is given.
If you share or repost any WIPs, visible artist credit is required.
You may not claim the artwork as your own.
You may not trace, heavily alter, redistribute, resell, or use the artwork for profit without permission. Minor cropping or formatting for personal use is allowed.
Commercial usage rights are not included by default and must be discussed separately.
Commercial usage rights are priced individually based on the intended use, scale, and distribution.

7. POSTING / PRIVACY

Unless discussed otherwise, I reserve the right to post WIPs and finished commissions on my social media, portfolio, and galleries.
Permanent private / unpublished commissions are +50% of the final commission price and must be requested before payment.
A temporary posting embargo may be arranged separately in advance.

8. AI / NFT / PROHIBITED USE

My artwork may not be used as input, reference, or source material for generative AI, AI-assisted editing, image-to-image generation, model training, datasets, or machine learning.
My artwork may not be minted, sold, or used in any NFT / blockchain-related project.
My artwork may not be used in any hateful, illegal, exploitative, or defamatory context.
My adoptable designs may not be used as input or source material for generative AI or AI-assisted character generation.

9. CONTENT LIMITS

Please review my current Price List for accepted subjects, content limits, and NSFW restrictions. I reserve the right to decline requests that fall outside my scope.

10. DELIVERY

Commissions are digital products only unless otherwise agreed.
Final files will be delivered digitally after completion.
The client is responsible for downloading and safely storing the delivered files.

11. CLIENT CONDUCT

Please communicate clearly and respectfully.
Repeated pressure, rudeness, harassment, or attempts to bypass my boundaries may result in cancellation of the commission.
Any applicable refund will be handled according to Section 5.

12. ADOPTABLE DESIGNS

The following terms apply to character designs / adoptables purchased directly from me.OWNERSHIP & CREDIT
Purchasing an adoptable gives you ownership of the character design, but I retain copyright to my original artwork and design presentation.
Do not claim the original design or my artwork as your own creation.
Do not remove, cover, or alter my signature / watermark on my original artwork.
Please keep me credited as the original designer where the platform allows designer credits.RESALE / TRANSFER
You may resell, trade, or gift the character.
You must notify me whenever ownership of one of my designs changes and, if possible, provide the username or profile of the new owner. It is important to me to know the current owner of my designs.
A design may not be resold for more than its original purchase price unless additional value has been added through commissioned artwork or other paid character assets.
Any increase in resale price should reasonably reflect the value of the additional paid artwork / assets.
Free artwork, gifts, or personal art should not be used to artificially inflate the resale price.
If exceptional personal circumstances require a different resale arrangement, you may contact me to discuss it.RESALE ASSISTANCE
I do not buy back previously sold designs.
I am not responsible for finding a new owner, advertising the resale, or otherwise assisting with resale.DESIGN USE
You may make reasonable personal changes to the character after purchase.
You may not turn one of my designs into an open species, closed species, species template, or a new species concept intended for distribution or sale without my permission.
Commercial use of my adoptable designs is not automatically included and must be discussed with me separately.
